A traditional speciality guaranteed (TSG; pl.: traditional specialities guaranteed) is a traditional food product protected under European Union and/or United Kingdom law. This label differs from the geographical indications protected designation of origin (PDO) and protected geographical indication (PGI) in that the TSG label does not certify that the protected food product has a link to a specific geographical area, and thus a product can be produced outside the area or country from which it originates. To qualify for the TSG label, a food must be of "specific character" and its raw materials, production method, or processing must be "traditional". Title III of European Union Regulation 1…

The Protection of Traditional Foods in the <scp>EU</scp>: Traditional Specialities Guaranteed. Abstract Since the dawn of the common market, the European Union has enacted abundant legislation regulating the employment of specific food names. This process has led to the introduction of a regulatory framework for wines and spirits, and four quality schemes for food products: protected denominations of origin ( PDO ), protected geographical indications ( PGI ), traditional specialities guaranteed ( TSG ), and optional quality terms ( OQT ). This paper focuses on the TSG . It will first determine the collocation of this quality scheme in the EU legal framework; second, it will conduct a legal…

This is a list of traditional specialties guaranteed by country. Traditional specialities guaranteed (TSGs, singular traditional speciality guaranteed) are traditional food products protected under EU and/or UK law. Three European Union schemes of geographical indications and traditional specialties, known as protected designation of origin (PDO), protected geographical indication (PGI), and traditional speciality guaranteed (TSG), promote and protect names of agricultural products and foodstuffs, wines and spirits. Products registered under one of the three schemes may be marked with the logo for that scheme to help identify those products. The schemes are based on the legal framework provided by the EU Regulation No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs. This regulation applies within the EU as well as i…

The Puzzle of Reputation in EU Protected Geographical Indications: Can Traditional Specialities Guaranteed Provide a Solution?. In EU GI Law, Protected Geographical Indications have become the predominant quality scheme and, in particular, the history of the product and their relationship with the area of origin has become the main origin link. This linking factor can lead to distortions, however. These notes reflect on the contribution that Traditional Specialities Guaranteed could provide to correct these issues. They lead to the conclusion that this is an idea worth exploring, although it has its drawbacks too.

Anatomy of Traditional Specialities Guaranteed: Analysis of the Functioning, Limitations and (Possible) Future of the Forgotten EU Quality Scheme. Abstract This article focuses on traditional specialities guaranteed (TSGs), the least researched of the EU quality schemes that also include the better known protected designation of origin (PDO) and protected geographical indication (PGI). Firstly, this contribution presents a historical account of the evolution of this quality label. Secondly, it illustrates the results of the first empirical analysis of the contents of the Single Documents for all the TSGs registered, thus providing an unprecedented view of their nature. Thirdly, it divides T…

8. Enforcing EU law. This chapter addresses the Treaty's provisions on the enforcement of EU law, particularly looking at Articles 258–260 TFEU (Treaty on the Functioning of the European Union). The European Commission's enforcement action, known as ‘infringement proceedings’, is set out in Article 258 TFEU. If the Commission proves an infringement has occurred, the Court of Justice of the European Union (CJEU) will issue a binding verdict that requires the Member State to rectify the breach: in other words, to amend its domestic laws until they are compliant with EU law. Article 260 TFEU makes clear, however, that the CJEU can only order ‘compliance’. Article 259 sets out a very similar pr…
