Sega Enterprises Ltd. v. Accolade, Inc., 977 F.2d 1510 (9th Cir. 1992), is a case in which the United States Court of Appeals for the Ninth Circuit applied American intellectual property law to the reverse engineering of computer software. Stemming from the publishing of several Sega Genesis games by video game publisher Accolade, which had disassembled Genesis software in order to publish games without being licensed by Sega, the case involved several overlapping issues, including the scope of copyright, permissible uses for trademarks, and the scope of the fair use doctrine for computer code. The case was filed in the U.S. District Court for the Northern District of California, which rule…

Lewis Galoob Toys, Inc. v. Nintendo of America, Inc. is a 1992 legal case where the United States Court of Appeals for the Ninth Circuit concluded that there was no copyright infringement made by the Game Genie, a video game accessory that allowed users to alter codes transmitted between game cartridges and the Nintendo Entertainment System, known informally as a cheat cartridge. The court determined that the Game Genie did not violate Nintendo's exclusive right to make derivative works of their games, because the Game Genie did not create a new permanent work. The court also found that the alterations produced by the Game Genie qualified as non-commercial fair use, and none of the alterati…

Intellectual property rights (IPRs) have been acknowledged and protected in China since 1980. China has acceded to the major international conventions on protection of rights to intellectual property. Domestically, protection of intellectual property law has also been established by government legislation, administrative regulations, and decrees in the areas of trademark, copyright, and patent. China first began accepting foreign IP concepts when foreign countries forced the Qing dynasty to accept them as part of the bilateral treaties that followed the Boxer Protocol (1901). The early People's Republic of China abolished the statutes enacted by China's Nationalist government and adopted an…

Reverse engineering (also known as backwards engineering or back engineering) is a process or method through which one attempts to understand through deductive reasoning how a previously made device, process, system, or piece of software accomplishes a task with very little (if any) insight into exactly how it does so. Depending on the system under consideration and the technologies employed, the knowledge gained during reverse engineering can help with repurposing obsolete objects, doing security analysis, or learning how something works. Although the process is specific to the object on which it is being performed, all reverse engineering processes consist of three basic steps: informatio…

Do regional trade agreements increase technology complexity of digital service export trade? Evidence from digital intellectual property rules.. Based on the technology complexity data of bilateral digital service exports of 64 representative economies in the world from 2010 to 2021, this paper uses the gravity model to explore the heterogeneous trade effects of Regional Trade Agreements (RTAs) from the perspective of digital intellectual property rules. The results show that the higher the commitment level of digital intellectual property rules in RTAs signed between the contracting parties, the more conducive to the enhancement of the technology complexity of bilateral digital service tra…

Legal infrastructure for transformative AI governance.. Most of our AI governance efforts focus on substance: What rules do we want in place? What limits or checks do we want to impose on AI development and deployment? But a key role for law is not only to establish substantive rules but also to establish legal and regulatory infrastructure to generate and implement rules. The transformative nature of AI calls especially for attention to building legal and regulatory frameworks. In this Perspective, I review three examples: the creation of registration regimes for frontier models; the creation of registration and identification regimes for autonomous agents; and the design of regulatory mar…

Research on intellectual property rights and legal liability definition of artificial intelligence-assisted pediatric disease diagnosis system.. Background Children's physiological development is immature, their symptoms are hidden and their diagnostic fault tolerance window is low, so they are the key protected population of public health. Although pediatric AI can alleviate the shortage of medical resources, the unclear definition of ownership and responsibility hinders its standardized development. Methods This study adopts a mixed-method paradigm, separating exploratory analysis and hypothesis testing modules. Based on 89 hospital AI diagnosis documents, 17 medical dispute cases and rel…
